The Patent Prosecution Highway (PPH) Agreement means that you can request accelerated examination of your patent application:

At the Danish Patent and Trademark Office (DKPTO) if the Canadian Intellectual Property Office (CIPO) has already accepted the corresponding patent claims as patentable in Canada.

At the Canadian Intellectual Property Office (CIPO) if the Danish Patent and Trademark Office (DKPTO) has already accepted the corresponding patent claims as patentable in Denmark.
Please note that it is not a prerequisite to using the PPH that the search and examination at the first patent office has reached the grant-of-patent stage. However, it is a prerequisite that the first patent office has found at least one of the corresponding patent claims to be allowable.
The PPH agreement with CIPO is a pilot project. It commenced on 1 October 2009 and has so far been extended until 30 September 2013. After this trial period DKPTO and CIPO will evaluate the results of the pilot program in order to determine whether and how the program should be fully implemented. The Offices may also terminate the PPH pilot program early, if the volume of participation exceeds the manageable level or for any other reason.

The completed request form must be placed uppermost when you send your PPH request to us.

Accelerated PPH processing at CIPO
Request for accelerated PPH processing at CIPO can be made by following the English guidelines or the French guidelines.
(It is estimated that use of the PPH will normally make it possible to obtain a first office action from CIPO within 3 months after CIPO received the request for PPH processing.)
