The Patent Prosecution Highway (PPH) Agreement means that from 1 March 2009 you can request accelerated examination of your patent application:
- At Danish Patent and Trademark Office (DKPTO) if Korean Intellectual Property Office (KIPO) has already accepted the corresponding patent claims as patentable in Korea.
- At Korean Intellectual Property Office (KIPO) if Danish Patent and Trademark Office (DKPTO) has already accepted the corresponding patent claims as patentable in Denmark.
Please note that it is not a prerequisite to using the PPH that the search and examination at the first patent office has reached the grant-of-patent stage. However, it is a prerequisite that the first patent office has found at least one of the corresponding patent claims to be patentable.
The PPH pilot program with KIPO was first planned to run for one year, however KIPO and DKPTO have decided to extend the PPH pilot program in order to collect more information before any formal decision on the program is made. The extension of the pilot program was jointly announced on 18 February 2010. Currently, no end date is fixed for the PPH pilot program. KIPO and DKPTO will continue to evaluate the results of the pilot program in order to determine whether and how the program should be fully implemented after a suitable trial period.

You can also use this checklist if you want be sure that you enclose all the necessary documentation when requesting accelerated PPH processing at DKPTO. The completed checklist must be placed uppermost when you send your PPH request to us.

Accelerated PPH processing at KIPO
Requests for accelerated PPH processing at KIPO can be made by following these guidelines.
(It is estimated that use of the PPH at KIPO will normally make it possible to obtain a first office action from KIPO within 2 months after KIPO has received the request for PPH processing.)
