PPH/PCT-PPH between Denmark and Brazil

The Danish Patent and Trademark Office (DKPTO) and the National Institute of Industrial Property of Brazil (INPI) have launched a PPH and a PCT-PPH pilot program commencing on 1 September 2018. These programs have a duration of two years.

Both Patent Prosecution Highway programs will leverage fast-track patent examination procedures at the DKPTO and INPI to allow applicants in Denmark and Brazil to obtain corresponding patents faster and more efficiently.


The PPH Program

Under the Patent Prosecution Highway, an applicant receiving an Office Action from the DKPTO or INPI stating that the claim(s) in a patent application has novelty, inventive step, and industrial applicability may request that the other patent office fast track the examination of corresponding claims in the corresponding applications.

The PCT-PPH Program
Under the PCT-Patent Prosecution Highway, an applicant receiving a written opinion or an international preliminary examination report from INPI that at least one claim in a PCT application has novelty, inventive step, and industrial applicability may request that the DKPTO fast track the examination of corresponding claims in corresponding applications.
